Terms of service

Terms of service are the legal agreements between us as a service provider and a person who wants to use our DevOps services.

Terms of Service (ToS) for Flexible DevOps Solutions by CloudPanda.io

Effective Date: 01.12.2024

These Terms of Service ("ToS") govern the use of Flexible DevOps Solutions ("the Service") provided by CloudPanda.io ("the Company") to businesses ("Client(s)"). By subscribing to or using the Service, you agree to the following terms:

1. Service Overview

CloudPanda.io offers subscription-based DevOps services tailored to businesses. Depending on the selected plan, the Service includes DevOps consultation, support, monitoring, updates, and other technical solutions outlined below.

2. Plans and Pricing

Clients may subscribe to one of the following plans:

Essential Support

  • $300/month
  • 5 hours of DevOps consultation included.
  • Additional support billed at $50/hour (time and materials).

Ongoing Development

  • $450/month
  • 10 hours of DevOps consultation included.
  • Additional support billed at $47.50/hour (5% discount).
  • Services include:
    • Log gathering
    • Monitoring
    • Periodic updates
    • Monthly security updates

Dedicated Team

  • $4,000/month
  • 40 hours of DevOps consultation included.
  • Additional support billed at $45/hour (10% discount).
  • Services include:
    • Log gathering
    • Monitoring
    • Periodic updates
    • Monthly security updates
    • Dedicated point of contact
    • App architecture consultancy
    • Guaranteed response time: 1 working day

3. Payment Terms

  • Payments are made monthly in advance.
  • Subscriptions will auto-renew unless canceled prior to the next billing cycle.
  • No refunds are provided unless CloudPanda.io terminates the agreement (see Section 11).

4. Refund Policy

Refunds are only issued in cases where CloudPanda.io terminates the contract with the Client, covering any unused portion of the subscription period.

5. Service Level Agreements (SLAs)

  • Guaranteed response time of 1 working day applies exclusively to the Dedicated Team plan.
  • Other plans do not include guaranteed response times.

6. Client Responsibilities

  • Clients must provide clear requirements and manage access to services that Flexible DevOps Solutions supports.
  • CloudPanda.io is not responsible for delays or issues arising from insufficient access or unclear requirements.

7. Limitations of Liability

CloudPanda.io offers support services but does not assume responsibility for:

  • Data loss
  • Security breaches
  • System failures caused by third-party services or client actions

8. Termination Policy

  • CloudPanda.io may terminate the agreement if the Client engages in unreasonable behavior. In such cases, a prorated refund for unused services will be provided.
  • Clients may terminate the subscription at any time. The agreement will end at the conclusion of the current billing period.

9. Communication

  • Slack is the official communication channel for all support and service requests.
  • Response times may vary depending on the subscribed plan.

10. Data Privacy

Data privacy is addressed in a separate agreement and complies with applicable regulations.

11. Support Services

Technical support is the core of our service and is included in all subscription plans as outlined in Section 2.

12. Amendments to Terms

CloudPanda.io reserves the right to update these Terms of Service. Clients will be notified of any significant changes.
